I. Harold Koretzky is a scheduled speaker - regarding the troublesome, union-sponsored Employee “Free Choice” Act expected to be enacted by the Democratic-controlled Congress with presidential approval early in 2009 - before an executive forum in Dallas TX on February 26, 2009, and before MAPS mediation forums in New Orleans and Baton Rouge, Louisiana on March 19 and 27, 2009, respectively.

Union-sponsored Employee “Free Choice” Act (“EFCA”) is Likely To Be Enacted in 2009

New Democratic Congress expected to pass this unprecedented legislation with presidential support.

Unions desperately need new members, and contributed $450 million to Democratic candidates in the Fall 2008 elections to ensure EFCA’s passage.

* Currently, a union is certified as a bargaining representative by the National Labor Relations Board (“NLRB”) following a secret ballot election held six to seven week into a campaign during which an employer can make its case for a union-free workplace.

* With EFCA’s passage, unions will gain certification without having to face an election by signing up a bare majority of the workforce - outside the presence of management - using peer pressure, “promises” and in some cases intimidation and threats.

* After a NLRB card check, contract negotiations will begin in just ten days; if agreement is not reached within ninety days, a Federal Mediation & Conciliation Service (“FMCS”) employed mediator will be dispatched to negotiate a settlement.

* Thirty days into the FMCS-conducted mediation, the terms of a two year union contract will be entrusted to a FMCS employed arbitrator.

* EFCA’s enhanced monetary penalties for employer interference with union organizing efforts and accompanying broad injunctive relief against employers will only enhance union organizing.

* Private sector employers - regardless of size - are at risk, and need to prepare now to maintain union-free workplaces as it may be too late once this union-friendly legislation becomes law.

With the help of a small board of directors, this organization has grown from 233 members when it was formed four years ago to 472 last year. It has awarded grants to community groups totaling about $1.3 million so far.

The organization's goal is to offer effective philanthropy through increased awareness, education and high-impact giving. The beneficiaries of the group's good works are children, the elderly, indigent and ailing.

Projects include the Good Samaritan Clinic, which serves the health-care needs of the working poor in Santa Rosa County; ARC Gateway, which serves developmentally disabled children and adults; Bravo for Kids, which helps provide musical instruments to middle schools students in Escambia and Santa Rosa counties; and the Northwest Florida Blood Center, which was in critical need of a new bloodmobile.

I. HAROLD KORETZKY, a founding member and labor and employment law partner, will lead a discussion of Human Resource professionals attending the Various Chemical Companies education program in San Antonio, Texas on October 4, 2007.  Mr. Koretzky’s topic is entitled “The Law in Today’s Work Place”, and covers a broad range of employment law topics which govern employment issues frequently addressed by human resource professionals.
 
Included in the subjects to be discussed are various forms of discrimination, harassment and retaliation (under a number of statutes, including Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, and the Age Discrimination in Employment Act).  Mr. Koretzky will also address employee discipline, record keeping (especially in view of recent case law regarding the Civil Rights Act of 1871), and various state and local employment laws, such as those governing covenants not to compete, employment contracts, the payment of employee wages, and state tort laws which can impact the employer-employee relationship.
 
The attendees will also be active participants in Mr. Koretzky’s presentation, as it will include case studies and role-playing to prompt group discussion regarding the human resource role in conducting a full and fair investigation of possible sexual harassment and other forms of employee misconduct which can expose an employer to liability if not properly addressed.
